| Re: I am submitting this complaint regarding a short-term rental listing advertised on Booking.com that appears to be operating in violation of New York City short-term rental laws. The listing is advertised at the following address: 261 W 29th St, New York, NY 10001. Associated Booking.com listing: https://www.booking.com/hotel/us/incentra-home-chelsea.html. Original address: 305 West 29th Street, Chelsea, New York, NY 10001. The listing is marketed as an entire-unit short-term rental. Based on the advertised format and description, the offering appears inconsistent with restrictions applicable to Class A multiple dwellings in New York City. New York State Multiple Dwelling Law 4(8)(a) prohibits the rental of a Class A multiple dwelling unit for periods of fewer than 30 days unless a permanent resident is present during the rental period. New York City Administrative Code 27-287.1 enforces this restriction. In addition, the NYC Short-Term Rental Registration Law (Local Law 18 of 2022) requires short-term rental hosts and booking services to ensure listings are lawfully registered and that required identifying and registration information is accurately disclosed. The advertised listing does not appear to display a valid short-term rental registration number or required disclosures. Based on publicly available information, the listing may not be in compliance with the above-referenced laws.
